SERVICES REGARDING REVISIÓN OF YOUR GENERAL PLAN
Act 7/2002 of December 17, regarding the Urban Development
of Andalusia [Ley de Ordenación Urbanística
de Andalucía published in the BOLETÍN
OFICIAL DE LA JUNTA DE ANDALUCÍA no. 429 of December
19 2002) has been in force since January 2003.
This Act requires that current PGOU (General Urban Plans)
be adapted to the new legislation, for which Town Councils
have a period of 4 years.
Revision of the PGOU of the town or village where you
have real property (land and/or dwelling) may significantly
alter the situation of your property on the basis of:
» A modification of land classification:
Change to land for urban development: prescribed, sectored,
non-sectored.
Change to urban land: consolidated, non-consolidated
» A modification of land zoning:
Residential
Industrial
Commercial
Facilities: Educational, Sport, Social
» Being subject to expropriation due
to:
Change to land for urban development
Change to urban land
The passage of a general system (road, railway, etc.)
or installation of public facilities, etc.
In addition, the Andalusian Act introduces the figure
of the Urban Planning Agent, which caused great controversy
and complaints on the part of European citizens in the
Region of Valencia who own a primary or secondary residence
there.
Regarding this controversy in the Region of
Valencia:
» An article was published on March 8th
2003 in “ Valencia Life”.
» A letter from the Ambassador of the United Kingdom
in Spain (Mr Stephen Wright) was published in the daily
newspaper “El Mundo”, number 318, on October 24th 2003.
» 17 ambassadors in Spain of European Union countries
wrote to the President of Spain (Mr Rodríguez
Zapatero) urging him to intervene in view of the “urban
development abuse” taking place in the region of Valencia.
» The European Parliament issued a report dated
25-28 May 2004 concerning “The Fact-finding Mission
to Valencia, Spain”. Petition 609/2003 by Charles Svoboda.
» The German television channel “Bayerischer Rundfunk”
and the British “New Skys Newsletter” have reported
the matter.

In consequence, it is very important to have detailed
information regarding the moment the Town Council of
the area where you have property approves the revision
of the PGOU.

of the PGOU (General Plan) of the locality where you
own property, and of the deadlines for allegations,
suggestions, appeals, etc.
